How Does a Mentally Ill Person Get a Gun? What's the Responsibility of the Gun Owner?

In the tragic deaths of 8 people and the injury to a handful of others in Omaha on Wednesday, the killer, a 19-year-old man with a long history of mental illness, used a semi-automatic AK-47 that police say he stole from his stepfather.

1) Why is any person who is not in the armed forces allowed to own an AK-47 assault rifle?
2) Failing this, why didn't the stepfather have a trigger lock on it?

The tragedies, in this case, may have been averted if these two questions were adequately answered. Instead, the story is about a mentally ill person who didn't act responsibly--which is the more insane notion?

No doubt the same questions will be raised about the gunman or gunmen who killed in Colorado yesterday.
